Construction company to pay $144K after worker injured: OHS

A construction company has agreed to pay a $144,000 fine after pleading guilty to one charge under the Occupational Health and Safety (OHS) Act following an incident where a work was injured on the job.

According to a Tuesday news release, on March 7, 2022, the worker removed a piece of plywood that was covering a piling hole, before taking a step and falling down the hole.

Marathon Underground Constructors Corporation pleaded guilty to the OHS charge for failing to ensure the health and safety of a worker. Six other OHS charges were withdrawn.

The company received what OHS refers to as a creative sentence, whereby money that would otherwise be paid as fines are directed to an organization or project to improve or promote workplace health and safety.

The fine will be paid to the Alberta Construction Safety Association (ACSA) to support developing a series of learning videos and a toolbox talk resource document.

Both the company and the Crown have up to 30 days to appeal the conviction or penalty.
